Terms of Service
Last updated 9 October 2026
This website at comparethat.com.au (Website) is operated by Compare That Holdings Pty Ltd (ABN 25 700 956 074) (CompareThat, we, our or us). Please read these Terms carefully. Our Privacy Policy forms part of these Terms.
1. Acceptance
1.1 These Terms govern your use of our Website. By accessing or using the Website you accept these Terms and agree to use the Website in accordance with them. You must stop using the Website if you do not agree.
1.2 We may vary these Terms at any time by publishing the amended Terms on the Website. We recommend you check this page regularly. Your continued use of the Website after a variation is taken to be acceptance of the amended Terms.
2. Our services
2.1 The Website provides comparative information about banking, finance and energy products in Australia. We show all of the product information we are able to access: for banking products, rates and fees are sourced from each provider’s Consumer Data Right (CDR) Product Reference Data, and other categories draw on the relevant published source (for example the Australian Energy Regulator for energy plans). Some listings are editorial selections and are identified as such. See where our data comes from. The products we compare are not representative of all products available in the market.
2.2 We are a comparison service only. We are not a credit provider, a broker or the holder of an Australian Credit Licence, we do not provide credit assistance or credit advice, and we do not process applications. Nothing on the Website takes into account your objectives, financial situation or needs. If our position on credit products changes, these Terms will change with it.
2.3 Different products on the Website are regulated under different regimes. Credit products, being home loans, personal loans, car loans and credit cards, are regulated under the National Consumer Credit Protection Act 2009 (Cth), where the relevant authorisation is an Australian Credit Licence. Deposit products (savings accounts and term deposits) and superannuation are financial products regulated under the Corporations Act 2001 (Cth), where the relevant authorisation is an Australian Financial Services Licence. For those products, CompareThat is a corporate authorised representative of Australia National Investment Group Pty Ltd, the holder of Australian Financial Services Licence No. 522028, and is authorised to provide general advice in relation to deposit products and superannuation only. We do not provide personal advice. Energy plans are regulated by the Australian Energy Regulator and are not financial products at all. In each case we publish comparative product information and refer you to the provider; we do not provide credit assistance, arrange the issue of any financial product, or act as your agent.
2.4 The comparative information and rates displayed are subject to change without notice. You should confirm the rates, fees, charges and full terms of any product with the relevant provider before acting.
2.5 If you decide to apply for a product, you deal directly with the provider on their own website and terms. Providers are not our employees, contractors or agents, and we are not a party to, and have no control over, any agreement between you and a provider.
2.6 We may receive fees or other benefits in connection with products on the Website other than credit products, including referral commissions and payments for inclusion or sponsored placement. We do not currently accept any payment in connection with credit products. This is explained in how we make money, how we sort and rank products, and our advertiser & sponsored content disclosure.
3. Prohibited conduct
3.1 You must not do, or attempt to do, anything unlawful, anything prohibited by laws that apply to your use of the Website, or anything that might bring us or the Website into disrepute, including: impersonating any person or entity or misrepresenting your affiliation; breaching another person’s privacy or other legal rights; using the Website to defame, harass, threaten or offend; interfering with other users; tampering with, modifying or damaging the Website, or transmitting viruses or other harmful code; or sending unsolicited messages.
3.2 You must not use the Website or its content in any way that competes with our business, and you must not scrape, harvest or systematically extract content except as permitted by law.
4. Collection notice
4.1 We collect personal information so you can access and use the Website, to respond to your enquiries and to communicate with you, as set out in our Privacy Policy. By providing personal information to us, you consent to us handling it in accordance with that policy. This clause survives termination.
5. Intellectual property
5.1 Unless otherwise indicated, we own or licence all rights (including intellectual property rights) in the Website and its content. We grant you a non-exclusive, revocable, non-transferable licence to use the Website in accordance with these Terms; all other uses are prohibited without our prior written consent.
5.2 You must not, without our prior written consent, copy, reproduce, republish, distribute, sell or create derivative works from the content, or frame or embed it in another website. This clause survives termination.
5.3 Clause 5.2 does not apply to the market averages published in our Rate Tracker, or to figures calculated from them, which you may reuse on the conditions set out under Reusing These Figures. That permission does not extend to any other content, including figures published by the Reserve Bank of Australia or product information published by providers.
6. Warranties and disclaimers
6.1 To the extent permitted by law, we make no representations or warranties that the Website or its content is complete, accurate, reliable, up to date or fit for any particular purpose, or that access will be uninterrupted, secure or error-free. You use the Website and act on its content at your own risk.
6.2 The content is general information only. It is not personal advice and does not take into account your needs, objectives or financial circumstances. We are a neutral facilitator; we do not endorse any provider, and you should satisfy yourself as to a provider’s suitability. This clause survives termination.
7. Limitation of liability
7.1 To the maximum extent permitted by law, we exclude liability for any loss or damage (including indirect, consequential, or loss of profits, data, reputation or goodwill) arising out of or in connection with your use of, or inability to access, the Website, any interruption to it, or any content that is incomplete, incorrect or out of date.
7.2 To the maximum extent permitted by law, our liability for breach of any non-excludable guarantee is limited, at our option, to supplying the services again or paying the cost of having them supplied again. This clause survives termination.
7.3 Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy under the Australian Consumer Law, or any other legislation, that cannot lawfully be excluded, restricted or modified.
8. Termination
8.1 We may suspend, terminate or limit your access to the Website if you breach these Terms or any applicable law. You may stop using the Website at any time. We may stop making the Website (or any part of it) available without prior notice.
9. Disputes
9.1 If a dispute arises in connection with these Terms, the party claiming a dispute must give written notice to the other setting out the details and a proposed resolution. The parties must then attempt in good faith to resolve it before commencing proceedings (except where urgent interlocutory relief is sought).
10. General
10.1 A failure or delay in exercising a right is not a waiver of it. 10.2 These Terms do not create a partnership, joint venture or agency relationship. 10.3 The Website may contain links to third-party websites which we do not control or endorse and are not responsible for. 10.4 If any provision is held invalid or unenforceable, it is read down or severed without affecting the rest. 10.5 You must not assign your rights under these Terms without our consent. 10.6 These Terms are the entire agreement between you and us about their subject matter.
10.7 These Terms are governed by the laws of Queensland, Australia, and you submit to the non-exclusive jurisdiction of the courts of Queensland. In relation to deposit products and superannuation, these Terms are instead governed by the laws of Victoria and New South Wales, and you submit to the non-exclusive jurisdiction of the courts of those states. If you access the Website from outside Australia, you do so at your own risk and are responsible for complying with local laws.
